Heriberto Munoz-Juarez, 32, was charged with aggravated assault in connection with the shooting of his brother-in-law, 30-year-old Hector Hernandez, Canton Police said in a release Thursday.
Hernandez was shot at a Lakeview Drive location Wednesday afternoon, police said.
According to the Canton Police Department, Hernandez was shot in the chest during an argument with his brother-in-law.
“(The argument) was over a family issue,” said Lt. Jeff Tucker, spokesperson for the Canton Police Department.
Munoz-Juarez is being held at the Cherokee County Adult Detention Center without bond, according to the Cherokee Sheriff’s Office.
In addition to the aggravated assault charge, the suspect has a probation violation and an Immigration and Customs Enforcement hold, according to Sheriff’s Office officials.
Hernandez underwent surgery at WellStar Kennestone Hospital, where he remains in stable condition, police officials said.
Heriberto Munoz-Juarez was arrested Thursday at his home on Country Carpet Lane in Canton.
Another man, Eduardo Munoz-Juarez, of the same address was originally arrested and charged with aggravated assault in the incident also, but those charges were later dropped.
However, Eduardo Munoz-Juarez is also being held for ICE at the Cherokee County Adult Detention Center, according to the Sheriff’s Office.
Tucker said a language barrier as well as the storm Wednesday made the investigation difficult.
